Tali acquisti sono riservati agli utenti del Sito che intendono avvalersi dei servizi di vendita dei Prodotti (di seguito Clienti).<\/br><\/br>\nIl Cliente \u00e8 tenuto ad informarsi e a prendere visione delle presenti Condizioni Generali prima di completare l\u2019acquisto sul Sito. 6 \u2013 Modalit\u00e0 d\u2019acquisto<\/strong><\/br><\/br>\nLe caratteristiche essenziali ed i prezzi dei Prodotti sono riportati nell\u2019offerta relativa a ciascun singolo Prodotto presente sul Sito.<\/br><\/br>\nPer l\u2019acquisto dei Prodotti il Cliente dovr\u00e0 compilare e inviare a moodfineart.com il modulo d\u2019ordine di acquisto in formato elettronico, seguendo le istruzioni contenute nel Sito. Il Cliente dovr\u00e0 mettere il prodotto nell\u2019apposito \u201cshopping cart\u201d e, dopo aver visionato e accettato le Condizioni Generali, la Privacy Policy e le condizioni sul diritto di recesso, dovr\u00e0 selezionare il tipo di pagamento desiderato e scegliere l\u2019opzione \u201cacquista\u201d.<\/br><\/br>\nGli ordini possono essere effettuati senza registrazione e creazione di un account personale del cliente, come da paragrafi precedenti, seguendo i passaggi e le istruzioni specificate nel Sito stesso.<\/br><\/br><\/p>\n\n\n\n

7 \u2013 Modalit\u00e0 di pagamento<\/strong><\/br><\/br>\nIl Cliente potr\u00e0 effettuare il pagamento del prezzo dei Prodotti mediante carta di credito tramite i gateway di pagamento elettronico installati sul Sito.<\/br><\/br>\nmoodfineart.com accetta i pagamenti effettuati con carta di credito.<\/br><\/br>\nAl fine di prevenire le frodi su Internet, il pagamento effettuato mediante il Sito viene gestito in rete dalla banca interessata attraverso gli strumenti offerti dal circuito Visa \u2013 Master Card \u2013 American Express. Questa societ\u00e0 \u00e8 responsabile della conservazione e del trattamento automatico in un ambiente protetto delle informazioni relative a ciascun ordine, ivi incluse le informazioni finanziarie. Tutte le informazioni finanziarie, come il numero di carta di credito, la data di scadenza, eccetera, sono direttamente gestite dal circuito Visa \u2013 Master Card \u2013 American Express, che garantisce la sicurezza delle transazioni online. moodfineart.com non viene mai a conoscenza degli estremi della carta di credito e non \u00e8 quindi in grado di archiviarli o conservarli in alcun modo.<\/br><\/br>\nLa transazione sar\u00e0 addebitata sulla carta di credito del Cliente solo dopo che saranno stati verificati i dati della carta di credito, che sar\u00e0 stata ricevuta l\u2019autorizzazione di addebito da parte della societ\u00e0 emittente la carta di credito utilizzata dal Cliente, che sar\u00e0 stata confermata la disponibilit\u00e0 del Prodotto da parte di moodfineart.com e dunque dopo che l\u2019ordine sar\u00e0 pronto ad essere evaso.<\/br><\/br><\/p>\n\n\n\n

8 \u2013 Spedizioni e tasse<\/strong><\/br><\/br>\nmoodfineart.com spedisce con la formula DDP (Delivery Duty Paid) in tutto il mondo.<\/br><\/br>\nNel caso che l\u2019indirizzo di spedizione della merce sia in un Paese facente parte della Comunit\u00e0 Europea, la merce \u00e8 soggetta ad imposizione IVA (22%); nel caso in cui l\u2019indirizzo di spedizione della merce sia in un Paese NON facente parte della Comunit\u00e0 Europea, ai sensi dell\u2019Art. 8, c. 1, lett. a) \u2013 21 \u2013 23, D.P.R. n. 633\/1972, la merce non \u00e8 soggetta ad imposizione IVA.<\/br><\/br>\nLe eventuali tasse doganali e imposte saranno calcolate ed applicate dalle autorit\u00e0 doganali competenti. Tali spese non saranno mai da ritenersi a carico di moodfineart.com.<\/br><\/br><\/p>\n\n\n\n

9 \u2013 Trasporto e consegna<\/strong><\/br><\/br>\nPer la consegna dei suoi acquisti, il Cliente pu\u00f2 scegliere la propria residenza o il proprio domicilio, il posto di lavoro, o l\u2019indirizzo privato di persona fisica a sua scelta. Per motivi di sicurezza non saranno effettuate consegne a caselle postali e l\u2019ordine non sar\u00e0 evaso.<\/br><\/br>\nPer ogni ordine effettuato sul Sito, moodfineart.com emette ricevuta o fattura della merce spedita, inviandola all\u2019intestatario dell\u2019ordine, ai sensi del D.P.R. 445\/2000 e del D.Lgs. 52\/2004. Per l\u2019emissione della ricevuta o della fattura fanno fede le informazioni fornite dal Cliente all\u2019atto dell\u2019ordine. Nessuna variazione in fattura\/ricevuta sar\u00e0 possibile dopo l\u2019emissione della stessa.<\/br><\/br>\nLe spese di consegna sono a carico di moodfineart.com.<\/br><\/br>\nGli acquisti verranno consegnati mediante corriere ed inviati il giorno lavorativo successivo alla data di conclusione dell\u2019ordine.<\/br><\/br>\nGli ordini saranno evasi e consegnati dal luned\u00ec al venerd\u00ec, esclusi festivi e feste nazionali. moodfineart.com non \u00e8 responsabile per ritardi non prevedibili, fermo restando che, salvo i casi di forza maggiore, i Prodotti saranno consegnati entro un termine massimo di 15 (quindici) giorni lavorativi a decorrere dal giorno successivo a quello in cui il Cliente ha trasmesso l\u2019ordine a moodfineart.com.<\/br><\/br>\nPer la consegna della merce \u00e8 necessaria la presenza del Cliente o di un suo incaricato all\u2019indirizzo del destinatario indicato nell\u2019ordine. Al momento della consegna della merce da parte del Corriere, il Cliente \u00e8 tenuto a controllare che l\u2019imballo risulti integro, non danneggiato, n\u00e9 bagnato o comunque alterato, anche nei materiali di chiusura. Eventuali danni all\u2019imballo e\/o al prodotto o la mancata corrispondenza del numero dei colli o delle indicazioni devono essere immediatamente contestati, apponendo una riserva di controllo scritta sulla prova di consegna del Corriere. Una volta firmato il documento del Corriere, il Cliente non potr\u00e0 opporre alcuna contestazione circa le caratteristiche esteriori di quanto consegnato.<\/br><\/br>\nQualora non sia in grado di consegnare la merce ordinata a seguito della sopravvenuta indisponibilit\u00e0, anche temporanea, dei Prodotti, moodfineart.com ne dar\u00e0 tempestivamente comunicazione al Cliente, e comunque non oltre i 15 (quindici) giorni, tramite posta elettronica. L\u2019importo gi\u00e0 pagato dal Cliente sar\u00e0 rimborsato il pi\u00f9 presto possibile, e comunque non oltre 30 (trenta) giorni dalla ricezione dell\u2019ordine di acquisto.<\/br><\/br><\/p>\n\n\n\n

10 \u2013 Numero di spedizione<\/strong><\/br><\/br>\nmoodfineart.com invier\u00e0 al Cliente una e-mail di conferma una volta spediti i Prodotti.<\/br><\/br>\nAl fine di garantire la sicurezza della consegna del Prodotto, moodfineart.com conserver\u00e0 il numero di spedizione di ciascuna consegna effettuata.<\/br><\/br><\/p>\n\n\n\n

11 \u2013 Resi, cancellazione degli ordini e diritto di recesso<\/strong><\/br><\/br>\nmoodfineart.com intende garantire la completa soddisfazione del Cliente.<\/br><\/br>\nmoodfineart.com rimborser\u00e0 il costo dei Prodotti che siano restituiti dal Cliente non usati e non danneggiati, nonch\u00e9 accompagnati dalla relativa fattura\/ricevuta. I costi sostenuti da\u00a0moodfineart.com\u00a0per eventuale sdoganamento della merce resa, verranno stornati dall\u2019importo del rimborso.<\/br><\/br>\nI rimborsi verranno effettuati con la medesima modalit\u00e0 di pagamento prevista per l\u2019acquisto.<\/br><\/br>\nLa merce acquistata potr\u00e0 essere restituita entro massimo 15 (quindici) giorni dalla data di consegna. I costi di consegna non sono rimborsabili.<\/br><\/br>\nLe spese di consegna per la restituzione dei Prodotti sono a carico del Cliente; qualsiasi costo sostenuto dal Cliente per la riconsegna non sar\u00e0 rimborsabile.<\/br><\/br>\nmoodfineart.com si riserva il diritto di rifiutare la restituzione di quei Prodotti che non risultino conformi ai requisiti di cui al precedente paragrafo.<\/br><\/br>\nmoodfineart.com si impegner\u00e0 a rimborsare tempestivamente il Cliente entro e non oltre 30 giorni dalla data di ricevimento dell\u2019ordine scritto di cancellazione e restituzione del prodotto. moodfineart.com invier\u00e0 una e-mail di notifica una volta effettuato il rimborso.<\/br><\/br>\nSi raccomanda di spedire i Prodotti da restituire usando un corriere assicurato ai fini di rintracciare la spedizione. moodfineart.com non sar\u00e0 responsabile per il rimborso o risarcimento per quei prodotti rispediti che siano andati perduti, che siano stati rubati o danneggiati. Ai sensi dell\u2019Art. 64 del D. Lgs. n. 206\/2005, il Cliente ha diritto di recedere dal contratto senza alcuna penalit\u00e0 e senza specificarne il motivo entro il termine di 15 (quindici) giorni lavorativi che decorrono dalla data di ricevimento dei Prodotti, fatto salvo quanto previsto nei successivi paragrafi. Per esercitare il diritto di recesso, il Cliente dovr\u00e0 inviare al seguente indirizzo di posta elettronica art@moodfineart.com, una comunicazione scritta contenente:
<\/br>\n\u2013 la manifestazione di volont\u00e0 di avvalersi del diritto di recesso ai sensi dell\u2019art. 64 del D. Lgs. 206\/2005;
\n\u2013 l\u2019indicazione dei Prodotti per i quali il Cliente vuole avvalersi del diritto di recesso;
\n\u2013 il numero progressivo d\u2019ordine rilasciato al momento dell\u2019acquisto.<\/br><\/br>\nLa comunicazione pu\u00f2 essere inviata sempre entro il suddetto termine di 15 (quindici) giorni lavorativi anche mediante telegramma, telex, fax a condizione che sia confermata mediante lettera raccomandata con avviso di ricevimento entro le successive 48 ore.<\/br><\/br>\nQualora il Cliente desideri modificare o cancellare l\u2019ordine presentato, dovr\u00e0 inviare una e-mail all\u2019indirizzo art@moodfineart.com, entro 24 ore da quando \u00e8 stato effettuato.<\/br><\/br>\nmoodfineart.com far\u00e0 tutto il possibile per soddisfare la richiesta del Cliente. Tuttavia una volta che il Prodotto sar\u00e0 stato spedito, l\u2019ordine non potr\u00e0 essere cancellato o modificato sino al momento in cui la merce spedita sia stata restituita a moodfineart.com.<\/br><\/br><\/p>\n\n\n\n

12 \u2013 Responsabilit\u00e0 per difetti<\/strong><\/br><\/br>\nLaddove il Cliente ritenga che il Prodotto non sia conforme al Contratto o sia affetto da vizi, dovr\u00e0 darne pronta comunicazione inviando una mail a moodfineart.com, specificando il Prodotto oggetto di contestazione ed i vizi o le difformit\u00e0 riscontrate. Il Prodotto contestato dovr\u00e0 essere restituito a\u00a0moodfineart.com\u00a0unitamente a copia cartacea della mail inviata per la contestazione.<\/br><\/br>\nmoodfineart.com esaminer\u00e0 il Prodotto Contestato e comunicher\u00e0 via e-mail al Cliente se ha diritto o meno al rimborso del prezzo o alla sostituzione del Prodotto. L\u2019eventuale rimborso coprir\u00e0 il prezzo di acquisto pagato dal Cliente e le eventuali spese di restituzione a moodfineart.com. Il rimborso o la sostituzione avverranno entro 30 (trenta) giorni dall\u2019avviso via email con il quale moodfineart.com comunica all\u2019Utente che ha diritto al rimborso o alla sostituzione del Prodotto.<\/br><\/br>\nmoodfineart.com non \u00e8 responsabile per difetti dei Prodotti che siano stati causati dalla consegna effettuata da terzi.<\/br><\/br>\nmoodfineart.com non \u00e8 responsabile per danni conseguenti ad uso improprio del Prodotto, alterazione dello stesso, normale usura oppure negligenza nella cura del Prodotto stesso.<\/br><\/br><\/p>\n\n\n\n

This company is responsible for storing and automatically processing in a protected environment the information relating to each order, including financial information. 8 \u2013 Shipping and taxes<\/strong><\/br><\/br>\nmoodfineart.com ships with the DDP (Delivery Duty Paid) formula all over the world.<\/br><\/br>\nIf the shipping address of the goods is in a country belonging to the European Community, the goods are subject to VAT (22%); in the event that the shipping address of the goods is in a country NOT part of the European Community, pursuant to Art. 8, c. 1, letter. a) \u2013 21 \u2013 23, Presidential Decree n.633\/1972, the goods are not subject to VAT.<\/br><\/br>\nAny customs duties and taxes will be calculated and applied by the competent customs authorities. 9 \u2013 Transport and delivery<\/strong><\/br><\/br>\nFor the delivery of his purchases, the Customer can choose his residence or domicile, his workplace, or the private address of a natural person of his choice. 11 \u2013 Returns, cancellation of orders and right of withdrawal<\/strong><\/br><\/br>\nmoodfineart.com intends to guarantee complete customer satisfaction.<\/br><\/br>\nmoodfineart.com will reimburse the cost of the Products that are returned by the Customer unused and undamaged, as well as accompanied by the relevant invoice\/receipt. \n\u2013 the indication of the Products for which the Customer wishes to exercise the right of withdrawal;
